  1. That "Marlin Lode" adverse suit was dismissed as per copy of final

    copy enclosed herewith; but that nll cc;.mtrovers:, w111s settled between tbe applic1;1nts for the two claims; nnd that these (Wester Union) entrymen desire thnt said Marlin entry shall go tG patent as entered, and will, if necessary relinquish their claim to the rliu'' conflist.

    was dismissed as per copy of final order enclosed; that all controversy be­ tween the entrymen of these two claims was settled; that tBe ·celest entrymen have relinquished all claim to the conflict etween these entries; and that said 'Monte Cltristo'' entrymen desire that the Monte Christe

    entry go to patent as entered, so far as recards tlds conflict.


  3. That it is eertainly a mistake to repose that the ''Mone Christo half is for the ground included from this entry in favor @f Justice Lode.

I should not undertake the patening of these claims for les• than $25.00. each placer for my part of the ordinary patent expenses. Protest and adve1rse proceedings would have to be arranred for as tlley came up. $35.00 fer each claim must be sent the Surveyor, General. The land must be p8id for at $2.50 per acre. Land Office fees would be $10.00 for the whole group•

.Abstracts of Title and Publication of Notice weuld be $20.00 for each

claim. These items make the whole cost of patenting, except adv rse and pro­ test proceedincs (which can't be figured out beforehand) and the Deput Surveyor's work, which I would have to consult a surveyor to determine.

    U my Application to Purchase in mntter of Georgiana OTOUJil fails to exclude in terms the areas 1n conflict with Sure. Nos. 5934 and 6008, it is clearly defective; and I am greatly obliged to you for pointing out my mistake.


    As to excluding parts of the lodes applied for as the Georgiana Group because of their over-lapping one another, I do not see how that can

    be done. Claimants wish to enter all the group as one claim; and the Surveyor estimates the over-lapping areas, to show that the total area is less than the sum of the several areas. Not part of any of these lOdes is to be excluded as such, from the entry; *he ''net areas" shown by the official

    field notes do not show exclusions by the applicants of part of their own

    lodes, but only show to which of their lodes the over-J,apping areas belong.


    l have lost my descriptions of the conflicts excluded in favor of the Charmion Group; but since that group is now an offiotal Rurvey, I refer to it by number as such in my Amended Application to Purchase, herewith enclosed. Please make this Amended Application thecne upon which you act only in case the original one does not exclude Surs. Nos. 5934 and 6008:

    the failure to make those exclusions is so bad a blunder that I «an scarue­

    ly believe l made it.

    to enter more than twice that amount, or 33.38 acres. The "Withers" survey makes it Stocks Entry embrace 44.34 acres.


    Will send you the papers, if you care to look them over. They are good redding. Hodges certifies that Stocks files the Application Feb. 28, 1885J while Noonan as his atty.-in--fact makes non-mineral •ffidavit the dame day.

    n fair dwelling hous and two cabins upon it. · REal estate tnen say this pro­ perty is worth $800. or $900. It is encumbered to the extend of ,soo or· more. the monthly rental has been $25.00. Until you authorize some one

    to rep1·esent you in the handling of this property, the tenants will pay nothing. Mrs. lfadley, the widow, is with.out any means of support aside from her own exortions. Her son will be, for st111ne years at leas, hindrance instead of a help. She has come here from Greely, where she was teaching some little children; and will return there as soon as some arrangeMent can be made as to this property. The mortgage holders are inclined to fore close, but agree not to do so, pending on getting word from you. Should

    be glad if you could come, and look things over for yourself. If you can not come. you had better send a general power of attorney, such as

    S.S. Hadley held, to some one here, giving the power to collect and receipt for rents and to raise money by mortgage upon the town lot (Lot a in Block 35, Bast Aspen, Pitlin Co., Colo.) Shis is to lower the present rate of interest on the mortgages, one of which draws 5 per cent per month. It is fortunate that you, and not the deceased Mr. Hadley appear as owner of the property; as it would not pay the expense of an deminiatration.

      There is nothing new as to claims agains Fox la Co.. The notes given them by Geo. P. Jones were turned over to the heaviest creditors; a thing which could not be prevented. The next heaviest creditors attacked the sale, levying on the stock as property of Fox• Co.; but the sale was held valicl. Fox is still here, but hns nothing tangible.

      Have just received power of attorney from Thos. B. Hadley, and instructions to make the most possible out of the property and turn over all the proceeds

      of town property to you, but to divide pro eeds of mining property half and half between you and him.


      This inclines me to say ''sell the town property while these instructions are gooct''. If any of the mining property turns out valuable, it will

      not be difficult to find out whose it is.

      So long as it has no assured value, it may be just as well to take good care of Titos. E. Hadley's other letter, and say nothing.


      I know of no law which entitles you to a pension, unless Mr. Hedley in his lifetime was entitled to one. However, you had better consult some attorney who is experienced in pension business.

      Sorry 1 cannot inform you as to military schools.

    Now, can Clavel include it in his proposed homestead entry, or must he imitiate B contest against Folsom, or must he again get leave to a mend his o. s., describing by lots instead of sub-divisions?

    lt seems very hard for Clavel, whoBe filing out-dates Folsom's, to be put into extra trouble and expense, just because Withers paid no heed to filings and made plats to suit himself.

    Does your office allow the plats to control when they disagree, es in this case, with the fU•ngs? The plat only gives Claval 120 acres, of the 160 he filed upon.


    I wish if possible to understand fully what Clavel should do, before offering his Hemestead Application again; because he speaks no englieh• knows very little, and can't take in many explanations in a life time.

        2. Get the publisher of the. Graphic to sign the Agreement of Publisher,

          provided always. that no other paper is published nearer to the claims.

          save some expense by having the three claims included in one abstract, in­ stead of three separate ones. Mail me the Abstract, Proof of Posting, Publisher's Agfeement and papers executed by Mr. Allen; and remit $70.00;

        Service upon you as her attorney-in-fact would give no jurisdiction over him. Please let me know what you like besti whether to answer at court and got to trial next term, or to stay out of court as long as we can.


        Unless there are reasons of which I know nothing, my impression is that an early trial day is best for our side of the case.

        I ordered a copy of complaint fro1n the Clerk's Office yesterday but he failed to make it 9S promised.


        It is the ordinary form for such complaints; claims that R. H. Wood

        et al. had been in poss•ssion ever since June 5, 1888; and that A. w. Batchelder tDk unlwwful possession some time last year.

        The ''Mascotte" location dates back to Mch. 14, 1885. If its discovery , was good, and the requisite amount of work hns been done each year, the cnse\ is an enay one to wind. The other side will be obliged to negative one \ or other of these :facts, to recover one the strenght of a location made \,,

        by them in 1888.

        and "Fork" Lodes were located last year; hence the 10 foot Discoveries

        Els shown by the field notes as ''sufficient to the Maintenance of possession for the pending year'', as per the circular of Mell. 24, 1887. N0 "assessment·• was due upon thom last year, and the claimant is allGWed the

        whole of this year to do his first $100.00 assessment. Sinking his Discoveries makes his possession good until the end of this year: So that, unless youi wish further froof that his Discoveries are valid, I fail to see what

        further showing you can demand as to those two Lodes.

        Sinking those Discoveries last year holds the claims throughout this year, just the same ae $100.00 wath of work on the A• E Lode last year holds it through this year.

        As

        Paragraph 5 of said circular says first that proof of expendituro ''may where the matter inquest1oned, consist of the afidavit of the applicant.'' ec. ut, after mentioning cases where agentR may make such affidavit of-the it says they must in all cases be corroborated.


        The L. O. officials at Leadville, Glenwood Springs and Gunnison have never required corroboration of affidavits made by applicants themselves, although I must say that your construction of the circular seems to me the moat straigh-forward one. Will furnish the corroboration at all events, We can only disagree in case you hold that something more than

        Complaint was filed Jan. 14, and Clerk•s record showa ''summons issued" aame date. The sheriff received said summons the 11th of this month. lu the mean time it had probably remained in the hands o:f plaintiffs' attorney. I have spent toclny in studying the authorities as to whether sirnply deliveri11g surnrnpus into the hands of the atto1•ney by tha clerk amounts to the "issuing" of summons within one month, as prescribed by our code; and aa forc d reluctantly to correbide that it does. The sheriff will doubtless returne the summons not served

        at the end af ten days, when publication will be ordered upon plaintiffs' application.


        James Ooughlin had an interest l was told, in a lease upon the Mascotte; and uless I am greatly mistaken. he was quite active in trying to get a patent survey made upon the Robert Wood claim.


        His name was not used in its location, but I think he expected to come in for an interest afterward. (am just now told by a friend of his, who ought to know, that he has no interest in the "Robert Wood")


        There is nothing to do but wait, in the adverse matter, unless it be to waina service and pleas.

        Please remflt $25.00 when so inclined. I have scarcely earned so much us yet, but\\!l.11 doubtless be of further use to you in this matter.

    Nothing bas been done in Mackey vs. Hopkins since you filed your answer Saw Mr. Bell, ptf:fs. atty. Don't think he will bring the case

    to trial. Am satisfied that if Mrs. Hopkins enters the land as heir of her deceased husbank, it is not subject to his debts, but that she takes

    it as entryman and not by descent. In other words, judgment should go against plaintiff upon his complaint alone. Bell has agredd to notify me of any further move which he may intend in the case.

    ln winding up the estate of Luard Foster, deceased,, I was appointed by the Court to guard the interes of the minor children ·, and was told that the widow also wished that I should look after her i.nterdst.

    The land has first been sold for $1400.00. The debts\chargeable

    against the land amount to $500.00. Only $400.00 was paid tn cash; bal­ \

    ance in notes secured by true• deed payable in one and two j ars. I have $870.00 in such notes, one half of which belong to Luard\'s widow,

some months ago, but the local office has not yet pnssed upon same.

There is talk here, which I do not feel entirely safe in ignoring, to the effect that the Stocks entry is going to patent regardless of the pending protest. I can conceive of no posaible ground for such Action, unless an

ex parte showing should be made et your office to the eppnrent effect that the adverse rights of protestants in this case did not ol'iginate prior to final entry; which (glaingly false) showing if made would seem to warrent the passing of said entry to patent under Sec. 7 of the Act of Mch. 3, 1891.

The protest in said case is n complete refutation of such a showing; but it is in the locnl office here, and I doubt if your office has a copy of RRme.


Will you please notify me before a,:ting upon anid matter, in case any ex pai-te step is attempted on the part of the entryman or his assigns?

Now, that off:l.ce refused to allow entriea without further proof of mineral discovery; not to satisfy itaelf, PS would be perfectly

proper, but because its office as believe that your instructions to them require it. They say to me in a letter of two days ago, they are s•tisfied that the G. L•.0. will require the evidence of existence and discovdry of valuable ntieral on the claim, in a case which I he,d just completed, and in which the Application, ne I assured them, was precisely ouch as your office is all the time issuing patents upon. They are now requiring in all cases a separate corroborated affidavit as to mineral discoveries: not to satisfy themselves, but to carry out what they mistakenly believe to be your positive instructions upon that point.


You will notice that this form of application gives the number of linear feet of a lilver bearing lode or vein which applicant swears he

owns and possesses. The date of its location is given, and recerence is had to L. c., which L, C. gives date of discovery. Tho field uotes

The first expense of your patent proceedings will be $152.00 to get an order of survey from the Surveyor-General. Abstracts of title should also be obtained now• so as to lose no time wRiting for them. They will

probably cost in the neighborhood of $50.00. The first payment, to begin with, should not be less than $200.00. I should prefer to have it $250.00, so that

I might pay the Deputy Surveyor part of his fees ns the work progressed.

Then, in about six weeks, $200.00 more. The survey would be approved in that time, most 16kely, and that would pay all the expenses except acreage for the land and publication of notice. At the end of another two months the final payment of $250.00 should be made, when Receiver's Rec6ipt would issue.

Of course, there might be delays to make the time longer; but your people would probably want the business to progress as fast as possible, and so they should be prepared to make the payments as stated: that is-

Answering yours of June 23 to J. D. Hooper, enclosing Genl. L. O. letter ''N" (copy) of June 17, 1891, I send new Statement of Fees and Charges and Proof that Plats ec. Remained Posted. The objection to the Abstracts of Title can not be remedied. I send a continuation of same up to date of entry; but a new set of abstracts up to June 1st, 1889 could

only be an exact copy of those aleady filed in the case. The fact is, the

records never.showed the title as the various owners claimed it; the owners greatly disagreed in their claims to shares in the property; but they finally agreed (and carried out the agreement) to deed the entire property to Mr. Hooper, and instructed hiin in writing, as J understand, to reconvey to each owner his interest as compromised and set out, so soon as patent issues. Jf deemed beet, I can probably make Mr. Hooper's memoranda of

the interests he is to convey a part of the records, s.nd thus of the ab­ stracts; but this will be showing the interests of countless heirs (end minors many of them) of mvners deceased since the making of the deed and agreement with Mr. Hooper. The citizenship of all these would then have to be· shown; and the ownership would never remain unchanged long enough to

get the complete proof. Since the abstracts do show interest in Mr. Hooper, and the acquiescence of all parties is shown by failure to adverse, it seems to me that no mistake would be made by patenting this entry. Am

satisfied that all persons interested desire it, and thAt refusing the patent will dep ive them of their property; as they are so scattered that they

will never get their record titles straight.

The chance of leasing and bonding the Picayme claim, which J mentioned to you in my first letter again shows a possibility of materializing; al­ though there are so many drawbacks that it hardly seems probabl••

The Picayme is only four acres and e fraction; too small territpry to

rist much work upon, unless other adjoining gx•ound could go with it.

I am interested also in claims upon both sides of it. There aro men who would like to work the Picayme and either of the others togethe:1· under lease and bond; but the owners are so numerous and some of them so contrary that it seems well-nigh impossible to get all to agree upon a plan of work.

Will let you know if the prospects brighten. It might be well for Mrs.

Blake and the other heirs (if there are others) to send powers of attorney to some one here to act for them i1 case an opportunity occurs to lease and bond.

The lease proposed now is for two years, with 20 per cent royalty and

a bonding price of $50,000.00 for the entire claim. I think ell the Picayme owners would agree to that, although not all of them have been heard from; but objections are raised by owners of the other claims. The surface indi­ cations upon these claims are not flattering, but they are in a pretty

good neighborhood.


If you can organize a strong mining company, I can offer you some first class territory for development, which has good mineral in small quantities to commence upon, and many indications of ''banagahood" with comparatively small outlay. Let me know if this interests you.

it made there; as we have no copy, and it would cost more to get one mnde here than there. Your last telegram made me believe that the Hon. Comm. was going at once into the case on the merits. It read, as received, candon delay case: and the operator agredd with me that candon was meant for cannot. There is no more likelihood of a settlement, and win is now

the watchword. File the affidavit of Mr. Thatcher. If you think advisable, we can get one or two more affidavits showing admissions by Williams himself that he means to mine upon his "ranch"


You will tind much useless lumber among the testimony. We care nothing for any mining claims except the Trueworthy and Accident. The other mineral protestants have pAid nothing and will pay nothing toward the protest expenses.

    Lot 9 as entered, is Lots 6 1 7 and 8 as subdividdd by survey of 1889 Stocks' certificate of right (see original papers in Genl. L. o. in matter of his said entry) is tor sixteen acres and a fraction. The

    tract entered (see Sur. Genl's certificate attached to my answer to motion) contains 53.14 acres. If you will get the motion over ruled because of th excess of area, it really decides the case upon the merits. This seems to me an easy proposition: his certificRte of right has written across its face the fact that it can not be used in the entry of more than twice and said area of 16.-- acres.


    The further fact, fully shown by Hyma.ns abstract of title, thnt Stocks sold all his possible interest three yeArs before entry was made in his name (see certified copy of so called "power of attorney" a tached to my said answer), seams to me ample reason for the 11.onr,ellation o:f. said entry. lt

The sherrif's return to the D. & R. Y. summons shQ\Ys two copies of same were served upon you Sept. 10, 1888. No tr1Rl seems to have been had as to correspondents in that case: so it must have been settled out of Court if at all. ff. T. Rogers and A. M. Stevenson ought to know what settlement was made, if any; by the roads.

If you remember J. w. Calvin's serving you Y(ith summons, it may recall to your mind whatever else was done by the D. &R. G. The Court records are so very imperfectly indexed that hunting them through is a very tedious task;

and I hardly :feel warranted in making an exhaustive aiH-iflh search until assured

that they show all the proceedings so far as you are concerned in and bound

Until the receipt of your letter, I had no idea that the Mabel wns owned by a stock company or corporation; but thought• and rather think still, that each of you as individu ls owned an undivided share in the claim. If sbch is the case, you can not prevent the other owners from leasing their

own interests; while as one but yourself can make any lease which will affect your interest in the slightest.


I saw the proposed lessee today. He iR not a mnn to inspire great confidence, being ignorant and irresponsible to a detr;reo; but claims that the owners of the AYtllio Gibson Mine will carry out the lease when he

gets it. The Mollie Gibson men are all right as to responsibility; and such men often use such tools as Mr. Martin, the lesee, to get leases for them.


Martin says he has alrendy a lease upon the Broadway claim, between your claim and the Pioneer Tunnel; and that negotiations are pending for the use of that tunnel for carrying on work in the Broadway und the Mabel as well. Says he has us lease upon the Sixty-Six: but talks up the

advantaps of working your claim through the Sixty-Six, in a way which leaves some doubts in my mind as to his sincerity.

I think of nothing else at present, as suggested by your inquiries. These statements are frankly volunteered, in confidence that you will not use them to my disadvantage. I am friendly with Mr. MArtin and with your co-owners in the Mabel who are nlso owners in the Sixty-Six.

I have gone carefully through the records of the Wichita Lode, and find everything satisfactory except your power of attorney to J. w. Taylor

That gives him full and irrevocable power to prosecute or compromise the case.


You know Mr. Bell told you here that he would get Taylor to release that power of attorney. I have talked to Bell since, and he will give me no notion of whnt he intends to do, until Taylor comes. I do not feel like bringing the case to trial until an understanding is had with these me. According to that power of attorney, Taylor could sell out

the whole things to Sandders at any time for $10.00 and you would have no

:teniedy.


Can you not see Mr. Taylor, and in Rome way gdt rid os such a power os he holds over the case? According to Mi·. Dell's statements, there is no reason why they should not now go on with the case; and he seems rather inclined to do so. At any rate, I see no means of getting rid of them

unless they are willing to drop it. I believe Taylor will be fully as ready to iet fair with you as Belli and that is why you had better see him at hie

I nni consulted by Charle Carter, a hntterod up veteron, full of bullet aud saber wounds, who has never applied for a pension. He has long since worn out his discharge, and can not give proxim9te dates of enrollment and discharge; but wns six years in the army, commencing in the regular Army before th e war.


He first fought Indians in Oregon, was in Sheridan's Command, a private in Compnny J. 4th Western Cnvnlry. His imeediate commander from that time to his severe wounding at Pittsburg Landing was Lieutenant. Gardner.

He thinks fthettt Gardner was killed, and knows of the whereabouts of none of his comrades. He came in today to make out an Invalid Application; but it seems to me he ought to do far better under the old law.


Looking up your circular which I have had on file for sometime, I con­ cluded to place the case in your hands.


Please send me the necessary papers for his execution. He says his discharge was forwarded to him from New York to Oregon. He enlisted at Salem,

Oregon. A bullet wound in the bend pains him, and, I think, affects

his mind.

Your letter says entrymen must show cause why said cancellation should not be made, but the letter ''N'' seems to actually hold part of the entry for cancellation. I shall be glad if the Genl. L. o. will retain

jurisdiction and regard this as a showing of canal; but thought best to shape

it as an appeal.

ants does not extend to this litigation• although some of them may engage me for the suit. The litigation may be costly, as the case will be brought in the Federal Court at Denver. From what I know of the facts, the Grand Pacific ought to win. The Hough heirs should promptly employ some attorney to represent them; but that is, if they think the claim of

sufficient value, as it certainly i , to justify A vigorous defense. Jf they

are not willing to go to the expense of a suit, they had better send powers of attorney to some one here to sell their interest for what it will bring.
